Estate Planning and Living Trusts: A Senior's Guide to Selling Your California Home
If you are a senior thinking about selling your home, you have probably heard the term "Living Trust" before. Maybe a family member mentioned it, or a friend told you they set one up after they sold their house. But what does it actually mean for you, and why does it matter right now?
I am going to answer those questions plainly, because I believe you deserve to understand your options before making big decisions. I have been licensed since 1988, and over those 35-plus years I have seen too many families go through the stress of probate court, surprise tax bills, and complicated estate transfers that could have been avoided with a little planning ahead. I wrote six books during the pandemic to help people navigate exactly these situations. What Is a Living Trust and Why Does It Matter?
A revocable Living Trust is a legal document that holds ownership of your assets, including your home, while you are alive. You remain in full control as the trustee. You can sell property, change beneficiaries, or dissolve the trust entirely whenever you wish. The key benefit is this: when you pass away, assets held in the trust transfer to your beneficiaries without going through probate court.
Probate in California is expensive and slow. It typically costs 4 to 8 percent of the gross value of your estate and can take nine to eighteen months. For a home worth $800,000, that could mean $40,000 or more in court and attorney fees before your family ever sees a dime. A properly funded Living Trust avoids that entirely. Your loved ones can inherit your home directly, without waiting months or paying those fees.
And here is some good news: transferring your home into a revocable Living Trust does NOT trigger a property tax reassessment under Proposition 13. California law specifically protects transfers into a trust where you remain the beneficiary. You will not see your taxes go up just because you set up a trust.
Proposition 19: A Significant Opportunity for Seniors
If you are 55 or older and selling your home in California, Proposition 19 gives you something truly valuable. You can transfer your current property tax base to a replacement home anywhere in the state, and you can do this up to three times in your lifetime. That means if you have been living in your home for decades with a tax bill of $3,000 a year while your neighbor's similar house is assessed at $8,000, you can take that low rate with you to your next home.
This is a game changer for seniors who want to downsize or relocate but have been worried about a huge property tax increase on a new home. As long as you sell your primary residence after age 55, buy or build a replacement within two years, and occupy it as your primary residence, you can file form BOE-19-B with the county assessor and lock in your favorable tax base.
I have worked with clients who were hesitant to sell their family home precisely because they were afraid of the tax consequences. Once they understood Prop 19, the whole picture changed. They could move into a smaller, more manageable home or a senior community and keep their property taxes under control.
Three Steps to Protect Your Home and Your Family
Here is a simple framework I share with the seniors I work with. These three steps can save your family thousands of dollars and countless hours of stress.
1. Create or Update Your Living Trust
If you already have a Living Trust, review it. Life changes like a move, a change in health, or the loss of a spouse mean your trust should be updated. If you do not have one, now is the time to set it up. A trust ensures that your home and other assets pass to your loved ones without the probate process. Make sure the trust is funded. That means your home's deed needs to be transferred into the trust's name. Many people set up a trust but never actually move their property into it, which defeats the purpose. I can help coordinate this with a qualified estate planning attorney.
2. Understand the Tax Benefits of Selling from a Trust
Selling your home from a revocable Living Trust works the same tax-wise as selling it individually. You still qualify for the capital gains exclusion of up to $250,000 if you are single or $500,000 for married couples on your primary residence. There is no penalty or special tax treatment that makes selling from a trust more expensive. And if you hold the property until death, your heirs receive a "step-up in basis" to the home's fair market value at that time, which can completely eliminate the capital gains tax they would otherwise owe.
3. Coordinate Your Sale with Your Estate Plan
When you sell your home, the proceeds should flow into your trust if it is properly structured. This protects those funds from probate just like the property itself would have been protected.
